Terms and Conditions at 4 Points CrossFit
  1. 4 Points CrossFit & Conditioning Randwick reserves the right to remove these products at any time, whilst honouring any contract we have with an existing member.
  2. COOLING OFF PERIOD: You can cancel your membership with us up to 7 days from the date of the agreement. This is only applicable to new membership agreements. If you cancel within the 7 day cooling off period, we will refund your money less the set up fee or the value of any promotional material we have given you upon joining with us.
  3. CORPORATE RATE: To obtain the corporate rate, a minimum of 5 people from the same business must be members with us. Corporate members are not eligible for discounts applied to contract or upfront options, however they have the same eligibility for suspensions and cancellations.
  4. MINIMUM AGE: The minimum age is 17. People under the age of 17 are required to provide a certificate from a parent or legal guardian.
  5. YOUR HEALTH: You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise. You recognise that the fitness coach(es) is/are not able to provide you with medical advice with regard to your fitness and that this information is used as a guideline to the limitations of your ability to exercise. You agree to not hold the certified trainer or directors of Intuition Exercising Mind Body Soul T/A 4 Points CrossFit & Conditioning liable for any injury that may occur during a 4 Points CrossFit & Conditioning session.
  6. PAYING FOR MEMBERSHIPS: Membership fees are paid in advance - weekly, fortnightly or monthly, based on your contract type by direct debit from a bank account or credit card.
  7. EZIDEBIT: We have authorised Ezidebit Pty Ltd to administer the collection of payments due on your behalf. All payments due by you are made directly to Ezidebit. It can take up to 3 days for payments to be processed from your nominated account on top of your membership fee. Ezidebit will charge the following:
    • i. One off administration fee: $2.50
    • ii. Charge to bank account per transaction attempt: $1.20
    • iii. Charge to credit card per transaction attempt: 2.5%
    • iv. Charge to AMEX/DINERS card per transaction attempt: 2.7%
  8. MEETING YOUR RESPONSIBILITIES: You must make sure that:
    • Your bank account can accept direct debit
    • There is sufficient money in your account on the payment day and the next 5 days
    • You tell us if you are transferring or closing your account, at least 72 hours before the next direct debit
    • You tell us about any changes to your credit card, such as expiry date or number at least 72 hours before your next debit
    • If a membership payment fails you will be liable for the failed dishonour payment fee from Ezidebit of $14.80 (incl. GST).
  9. WHAT HAPPENS IF YOUR PAYMENT IS DECLINED OR FAILS FOR ANY REASON? If you do not fully pay your fees on the due date, we will immediately suspend your account and access to 4 Points CrossFit & Conditioning Randwick until any outstanding balance has been paid and you have given us your account details. You will be liable for the dishonor fee of $14.80 (incl. GST) from Ezidebit. We will continue to debit your nominated account without notice until we have retrieved the total amount you owe 4 Points CrossFit & Conditioning Randwick. All costs and disbursements incurred by us in recovering payment or protecting and or enforcing our rights under this document, including legal cost incurred are payable by you on an indemnity basis. We reserve the right to charge 7% interest on any overdue accounts. 4 Points CrossFit & Conditioning Randwick will make reasonable efforts to let you know before hand by:
    • Phoning you or speaking to you at 4 Points CrossFit & Conditioning Randwick studio
    • Writing you an email or text with the email address or phone number you provided
    • For memberships in your name, you must make sure that the payment method you choose remains valid and current for the length of your agreement. This includes third party accounts. If the details you give us fail, you are liable for all resulting fees. You should update your details and are obligated to complete your minimum term.
  10. CAN 4 POINTS CROSSFIT & CONDITIONING CHANGE YOUR AGREEMENT? We may sometimes add to, or remove our terms and conditions. This includes changing an opening and closing hour, our services and facilities and membership fees. Sometimes, we may also close the studio for refurbishment to improve facilities. If this substantially reduces our ability to provide our service to you, we will reduce your membership fees accordingly on a pro-rata basis. The most up to date terms and conditions always apply. We will give you at least a 28 day notice of any changes. If we do not fulfill our obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won't have any other claim against us if this happens.
  11. CAN 4 POINTS INCREASE YOUR FEES? We reserve the right to increase your fees at any time after your agreement has ended. We will make reasonable efforts to tell you about this at least 28 days beforehand by writing to the contact details you last provided us with (which could be a text or email). We will consider that you have received our letter or email on the second business day after it was sent. Where we have made a reasonable effort to let you know about a fee increase, you authorise us to increase any debits from your nominated account.
  12. SUSPENSIONS & CANCELLATIONS: We understand that from time to time you may not be able to train due to holidays, rest periods, becoming sick or injured or wish to cancel your membership altogether. The following rules apply to suspensions and cancellations.

    SUSPENSIONS:

    • Memberships can be suspended at any time with a 7 days notice period
    • 4 week maximum suspension per year
    • A one off administration fee of $20 for each suspension
    • Suspensions cannot be backdated
    • Pro-rata suspensions are not allowed (ie, outside of the normal fortnightly billing cycle)
    • Suspension periods will not count towards your contractual minimum term and will extend any applicable minimum term by the number of suspended weeks taken
    • Membership may not be suspended during the notice period of a cancellation request.

    CANCELLATIONS:

    • Must complete your minimum contract term
    • Minimum 30 days notice in writing only
    • Will not accept verbal agreements via phone or text message
    • $0 cancellation fee
    • If cancelled membership and you sign up again you will sign to the most current membership offering.

    CANCELLATION WITHIN CONTRACT TIME:

    • Cancellation fee: 50% of the remainder of contract value in FULL.

    AN EXIT FEE DOES NOT APPLY UNDER THE FOLLOWING CIRCUMSTANCES:

    • Sickness / injury resulting in not being able to train for remainder of contract (must provide doctor's certificate).
  13. CLASS BOOKING & CANCELLATION POLICY: You understand that:
    • All classes must be booked prior to attending group training due to class number limitations, legal and safety reasons
    • If you are booked into a class and unable to attend, you must remove yourself from the class or waitlist a minimum of 2 hours prior to class start time
    • You will be charged a $10 late cancellation fee or no-show fee per class, which will be paid to a charity of 4 Points CrossFit & Conditioning
  14. PROOF OF AUTHORITY: USE OF IMAGE & NAME:
    • You agree to allow 4 Points CrossFit & Conditioning to take a video or photo to use for promotional purposes from time to time.
